Terms of Use

These Terms of Use govern your access to and use of PulseSafety, Inc. products and services, including the CommandCORE platform. By accessing or using our services, you agree to be bound by these terms.

What you agree to
when you use our services.

These terms apply to all users of PulseSafety products. Agency administrators are responsible for ensuring their personnel comply with these terms.

1. Acceptance of Terms

By accessing or using any PulseSafety product or service, you confirm that you are authorized to bind your agency to these Terms of Use, and that your agency accepts these terms in full. If you do not agree to these terms, you may not use our services.

2. Authorized Use

Our services are intended solely for use by authorized law enforcement agencies, their sworn officers, civilian staff, and designated administrators. You agree to use the services only for lawful purposes consistent with your agency's mission and applicable law, including but not limited to CJIS Security Policy requirements.

3. Account Responsibilities

Each user account is personal and may not be shared. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect unauthorized access to your account.

4. Prohibited Conduct

You agree not to: (a) access or attempt to access data belonging to another agency or tenant; (b) reverse-engineer, decompile, or attempt to extract the source code of any PulseSafety software; (c) use the services to store, transmit, or process data that violates applicable law; (d) use automated means to access the services in a manner that could impair their operation; or (e) remove or obscure any proprietary notices within the platform.

5. Data Ownership

All data your agency enters into PulseSafety products remains the exclusive property of your agency. We do not claim ownership of agency data, officer records, or citizen information. Your data will not be shared with third parties except as described in our Privacy Policy or as required by law.

6. Intellectual Property

The CommandCORE platform, including all software, design, documentation, and trademarks, is owned by PulseSafety, Inc. and protected by applicable intellectual property law. These Terms grant you a limited, non-exclusive, non-transferable license to use the services during your active subscription. No other rights are granted.

7. Compliance with Law

You are solely responsible for ensuring your use of our services complies with all applicable federal, state, and local laws, including CJIS Security Policy, applicable records retention requirements, and your agency's own policies and procedures. We provide tools to support compliance; final compliance responsibility rests with your agency.

8. Security Obligations

You agree to implement and maintain the security controls required by your applicable law and by CJIS Security Policy for any terminal or device that accesses CommandCORE. You must promptly report any security incidents or suspected breaches to [email protected].

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE.' TO THE MAXIMUM EXTENT PERMITTED BY LAW, PULSESAFETY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PULSESAFETY'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE FEES PAID BY YOUR AGENCY IN THE TWELVE MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL PULSESAFETY BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

11. Changes to These Terms

We may update these Terms of Use from time to time. We will notify agency administrators of material changes via email or an in-app notice at least 30 days before the changes take effect. Continued use of the services after the effective date of updated terms constitutes acceptance of the changes.

12. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Travis County, Texas.
